The very recent Privy Council judgment in Equity Trust v Halabi (aka Z Trusts) has clarified the rights of successive trustees to recover costs and expenses from an insolvent trust fund but has left us wondering whether our standard practice on a change of trusteeship needs to change.   Shân Warnock-Smith KC, who represented the successful Appellant, and Andrew De La Rosa (both of International Chancery and Trust Chambers) will share with us their thoughts on this and related issues for the first time since the judgment and invite general discussion.
