The speakers will consider the Cayman law test for capacity and how a trustee can deal with a scenario where a power holder’s capacity might be in question and what can be done to make a trust ‘capacity proof’.

The session will look at some practical tips for trustees when faced with capacity issues and what assistance may be available from the Cayman courts in such circumstances.
